The Law

According to Government regulation, your Landlord or letting agent must pay deposits received from you or someone on your behalf into a deposit protection scheme. The three schemes are:

  • Deposit Protection Service (Custodial and Insured)
  • MyDeposits - including deposits that were held by Capita
  • Tenancy Deposit Scheme

The basis for this requirement is to stop Landlords using a Tenants deposit money somewhere else and to make it easier to get your deposit back when your Tenancy comes to an end.

How to Claim?

If your Landlord failed to lodge the deposit with one of the 3 tenancy protection schemes within 30 days of the date on which the deposit was provided by the Tenant, the Landlord will be subject to a penalty.

The penalty is likely to be between 1-3 times the amount of deposit paid.
